Description of Service
Treasure Finder USA is a platform that allows sellers to list garage, estate, rummage, and moving sales, and allows buyers to discover and navigate to those sales. Treasure Finder USA is a listing and discovery platform only — we are not a party to any transaction between a buyer and a seller, and we do not guarantee the accuracy of any listing, the condition of any items, or the conduct of any user.
Eligibility
You must be at least 18 years old to create an account or list a sale on the Service.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating an account or listing a sale.
Seller Listings
Sellers are solely responsible for the accuracy of their listings, including sale location, dates, times, and description. Sellers agree not to list anything illegal to sell, and to conduct their sale safely and in accordance with all applicable local laws.
Buyer Conduct
Buyers agree to use the Service respectfully, and to conduct themselves safely and lawfully when attending sales found through the Service.
Fees
Treasure Finder USA may charge sellers a fee to list a sale on the Service. Certain listings may be offered free of charge as part of promotional programs (for example, a limited number of free listings per state). The Service is, and will remain, free for buyers.
No Liability for Transactions or In-Person Interactions
Treasure Finder USA facilitates discovery only. We are not responsible for, and disclaim all liability arising from: (a) any transaction between a buyer and seller; (b) the condition, safety, legality, or accuracy of any item or listing; (c) any interaction, dispute, injury, or loss arising from a buyer or seller meeting in person as a result of using the Service. You use the Service, and interact with other users, at your own risk.
Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREASURE FINDER USA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Account Termination
We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms, fraudulent or unsafe listings, or conduct that harms other users or the Service.
Intellectual Property
The Treasure Finder USA name, logo, and app design are the property of Treasure Finder USA. You may not use them without our permission.
Changes to the Service or Terms
We may modify or discontinue the Service, or update these Terms, at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
